Dr Ger Coffey (Course Director of the LLM/MA Human Rights in Criminal Justice master’s programme and member of the Centre for Crime, Justice & Victim Studies) delivered a conference paper entitled “The Non (Ne) Bis in Idem Principle in the ICCPR: Deconstructing Emerging Principles and Guidelines” at the Universal Declaration of Human Rights at Seventy; A Review of Successes and Challenges conference, 21st and 22nd June 2018. The conference was hosted by the Department of Law, National University of Ireland, Maynooth. The conference paper critiqued several key themes of the ne bis in idem principle in the International Covenant on Civil and Political Rights including the stage of criminal proceedings when the principle becomes applicable; exceptions to the principle such as a tainted acquittal or newly discovered evidence; and applicability to administrative or disciplinary proceedings following a criminal trial. The paper concluded with an examination of the internal operation (before a domestic court) and external operation (before a court of a different state party) of the ne bis in idem principle. The themes of the paper were critiqued through the lens of Human Rights Committee jurisprudence that revealed emerging principles and guidelines.
